Overview

When two or more previously independent undertakings merge or one or more previously independent undertakings merge or one or more undertakings acquire control of the whole or parts of one or more other undertakings, the undertaking acquiring control in the case of an acquisition or the parties to the merger or to the joint venture is/are to file the Concentration Notification Form prior to the implementation of the concentration. The form has to be submitted within 15 days from the conclusion of the agreement, the announcement of the public bid, or the acquisition of a controlling interest.

What you'll get

Once the form is filled and sent to the Office for Competition, the concentration would be evaluated and if it results that it will not lead to a substantial lessening of competition in the Maltese market or part thereof, the Director General will declare the concentration as a lawful concentration.

Eligibility

The form has to be filled if the combined aggregate turnover in Malta of the undertakings concerned in the preceding financial year exceeds €2,329,273.40 and each of the undertakings concerned has a turnover in Malta equivalent to at least 10% of the combined aggregate turnover of the undertakings concerned.

One may apply by downloading the Concentration Notification Form, filling it in and sending it to the Office. One original and two copies must be sent to the Office. A notification fee of €163.06 must be paid.
