Overview

A Data Altruism Organisation is a legal entity established to carry out data altruism activities and operate on a not-for-profit basis. Data altruism is defined as the voluntary sharing of data on the basis of the consent of data subjects or permission of data holders, as applicable, for objectives of general interest.

 

Recognised Data Altruism Organisations are entities that facilitate data sharing in accordance with the EU Data Governance Act (DGA) (Regulation (EU) 2022/868). Under the DGA, Data Altruism Organisations play a vital role in creating frameworks for data altruism that adhere to strict governance, transparency, and security standards, building trust in the voluntary data-sharing ecosystem. 
 

What you'll get

1)    Recognised data altruism organisations will be registered on Malta’s public national register and on the EU register of recognised data altruism organisations.

 

2)    Entity registered in the public national register of recognised data altruism organisation, may use the label ‘data altruism organisation recognised in the Union’ in its written and spoken communication, as well as a common logo.
 

Eligibility

1)    Data altruism organisation which has its main establishment in Malta. Alternatively, if the organisation is not established in the European Union, a legal representative shall be designated in one of the Member States in which the services are offered.  The entity shall be deemed to be under the jurisdiction of the Member State in which the legal representative is located.

 

2)    In order to qualify for registration in a public national register of recognised data altruism organisations, an entity shall:

 

a)    carry out data altruism activities; 
b)    be a legal person established pursuant to national law to meet objectives of general interest as provided for in national law, where applicable; 
c)    operate on a not-for-profit basis and be legally independent from any entity that operates on a for-profit basis; 
d)    carry out its data altruism activities through a structure that is functionally separate from its other activities.

2)    Send additional documents which demonstrate that the requirements are met to [email protected] and [email protected] 

Documents required

1)    Kindly provide documents as proof of identity and establishment of the Data Altruism Organisation’s legal form as explained in the registration form.

 

2)    In the case that a data altruism organisation meets the requirements of Article 18 but is not established in the Union, kindly provide:
a)    Designation by a written mandate of the data altruism organisation to act on the latter’s behalf with regards to the latter’s obligations under this Regulation.  


3)    In case that a legal representative is appointed: 
a)    If a legal entity is appointed as the Legal Representative kindly provide:
I.    Memorandum of Association documents detailing the corporate structure of the entity registered in Malta 
II.    If the entity was incorporated in another Member State or at European Union or European Economic Area level, any relevant document in line with the Member States’s/European governing legislation providing evidence of the corporate structure. 
III.    A copy of the Legal Representative’s ID Card or Passport of the legal entity. 
b)    In case that a natural person is appointed as the Legal Representative, kindly provide:
I.    Copy of ID Card or Passport.

 

4)    Any other documents which demonstrate that the requirements of Article 18 of the Regulation are met.
