Overview
The ‘Land at the Disposal of the Farmer’ form is a requirement that stems from Regulation (EU) 2021/2115 Article 4 paragraph 4, Regulation (EU) 2021/2115 paragraph 15 and Section 4.1.3 of the CAP Strategic Plan 2021 Report. The form serves as a farmers’ declaration, complemented, and signed by a Commissioner of Oaths attesting that the land is at the farmer’s disposal. The form needs to be signed on each page by applicant and Commissioner for Oaths. This procedure is required primarily for parcels intended to claim subsidy funds and for contestation cases where the procedure applies to all types of parcels.

By means of this form, a farmer is clarifying the title the farmer has on the land, which is a requirement for some type of requests to be processed.
Eligibility
All registered farmers who seek to either:
Register parcel/s and claim subsidy funds
Switch already registered parcels to claim subsidy funds
Modify boundaries that would result in an increase in area of more than 100 sqm.
Both the transferor and the transferee are required to fill the form in cases of transfers of parcels which were registered in the Integrated Administration and Control System (IACS) after the 31st of December 2017. If the parcel was registered before the 31st of December 2017 only the transferee is required to fill the form.
In case of contestations, the procedure applies to all reference parcel types.
How to apply
Fill in form which needs to be signed on each page by Applicant and Commissioner for Oaths. The requested Site Plan needs to be attached to the Form before presenting at the Commissioner for Oaths.
If Applicant does not have the Site Plan in hand, the Applicant needs to obtain a copy of the Site Plan from ARPA front office, before submission.
Once you fill in the form, print, and take in person the Form together with the required Site Plan to a Commissioner for Oaths.
A service to take an Oath is offered free of charge at ARPA Front Office, Ta’ Qali.
The Form needs to be signed on each page in front of the Commissioner for Oaths by both Applicant and the Commissioner for Oaths.
The Form needs to be submitted in person at ARPA Front Office Ta’ Qali Malta, OR at ARPA Government Experimental Farm in Xewkija Gozo.

Required supporting documents:
A site plan issued by the Integrated Administration and Control System (IACS), or a site plan approved by an architect in case of contestation (separate form) by the contestant only.
